This Terms of Service Agreement ("Agreement") is made between the Artist and the Client concerning the commission of artwork ("Work"). By commissioning the Artist, the Client agrees to the following terms:
ENGAGEMENT
- The Client grants the Artist non-exclusive rights to observe and replicate the Client’s original character design, reference material, and other intellectual property solely for the purpose of completing the Work
- The Client warrants that they have the authority to enter into this agreement, act as the point of contact, and are solely responsible for decisions and approvals throughout the process
- The Artist strives to perform to the best of their ability in good faith and warrants that the Work is 100% original to the best of their knowledge
- The Artist may use commercially licensed, copyright-free, and/or educational materials, assets, and/or tools in the creation of the Work
- The Artist warrants that they will not copy or heavily reference unauthorized materials
- The Artist reserves the right to refuse projects or requests based on content, subject, or other reasons
CONTENT RESTRICTIONS
- The Artist will not create content that is explicit, offensive, or inappropriate. Specific guidelines for acceptable and unacceptable content vary by service and are detailed on each service's information page
TIMELINE and PROCESS
- If placed on a "Waitlist" slot, the Artist will inform the Client and agree on the duration of the waitlist and the expected timeframe for when an "OPEN" slot will be available. The waitlist queue typically lasts for a week or more, depending on the current workload
- Work completion requires a minimum amount of business days based on the service's listed minimum days and completion may extend for more, depending on the project. Orders with deadlines shorter than the minimum required business days will incur a rush order fee. Please refer to Section "Payments and Fees: Term 4" for details
- The timeline varies based on service type, complexity, and workload
- The Artist provides progress updates and seeks Client feedback voluntarily
- Final deliverables are provided through the VGen platform
